The Justice Support Foundation Affiliated by the Arab Center for Independence of Judiciary and Legal Profession (ACIJLP) filed Appeal No. 83 of the 70th judicial year before the Supreme Administrative Court

 

The Justice Support Foundation Affiliated by the Arab Center for Independence of Judiciary and Legal Profession (ACIJLP) filed Appeal No. 83 of the 70th judicial year before the Supreme Administrative Court, we appealed the ruling issued in Case No. 65897 of the 77th judicial year.

Mr. Nasser Amin, The legal representative of the Justice Support Foundation, had filed an appeal against the President of the Republic’s decision to appoint Counselor Hosni Hassan Abdel Latif Abu Zaid as President of the Court of Cassation, in violation to Article no. 185 of the Constitution, and Article no. 44 of Law no. 77 of 2019 which stipulated that the President of the Court of Cassation is to be appointed by a presidential decree from among the seven most senior vice-presidents of the Court, while the contested appointment decision picked the eighth deputy in the ranking of the vice-presidents of the Court of Cassation.

The appeal was considered at the 8/8/2023 hearing, and the court reviewed all the procedures on the same day. The Board of Commissioners submitted its report, and the ruling was issued on the same day not to accept the lawsuit due to lack of capacity and interest.

This prompted the Justice Support institution to appeal the ruling before the Supreme Administrative Court. The appeal was based on verifying the capacity and interest in the appeal of the Justice Support Institution as one of the human rights organizations concerned with justice and the independence of the judiciary, as included in its official regulations, in addition to the violation of the right of defense, as the Justice Support Institution was unable to respond to the government’s memorandum, the intervention petition, and the report of the body of commissioners, since it was time-bounded; It took only an hour and a half to write its memorandum, and the Justice Support Institution will pursue the appeal before the Supreme Administrative Court, submit documents and memorandums that prove its right to the lawsuit, and prove the invalidity of the President of the Republic’s decision to appoint the President of the Court of Cassation for its grave violation to the Constitution and the law.
