The ACIJLP launch an Initiative of a Law to establish a Commission for Truth and Justice in Egypt

 

In an attempt to support mechanisms and programs of transitional justice which aim to achieve a safe and peaceful transition to the Egyptian society to democracy and human rights, the Arab Center for Independence of the Judiciary and Legal Professions (ACIJLP) submit a draft law to establish a Commission for Truth and Justice in Egypt. The ACIJLP submits this project to all of chancellor\ Amin El Mahdi, Minister of transitional justice, and Mr. Muhammad Fa'iq, head of the National Council for Human Rights.

The draft law entitled "the commission of truth and justice," submitted by the ACIJLP includes the establishment of an independent and civilian body composed of a judicial component, called the " commission of the truth and justice," which have a legal personality and financial and administrative independence, and consists of six standing committees established by the Commission, a committee for documenting violations and fact finding, Committee for accountability and judicial investigations, committee for institutional reform legislation, a committee for reparation and compensation and rehabilitation and a committee for the Amnesty  and the Committee for Memorial.

According to this law, the commission aims to take the necessary measures on the judicial prosecution, and to hold accountable those involved in the commission of crimes and violations, and to ensure that there is no impunity, within the framework of the rule of law and the fair and equitable trial guarantees as well as to take all necessary measures towards folding pages of the past, and work to strengthen national unity and equity, in the spirit of understanding, justice and accountability, and without functional or substantive or procedural immunities.

The draft law consists of ten chapters on the origins and functions of the Commission and its powers, in addition to chapters relevant to the objectives and method of work of the main committees and penalties. The draft law also included he establishment of a court which have jurisdiction on issues related to the revolution consists of one or more circuit of the courts of appeal all over the Republic, to consider issues related to the revolution and which have occurred since the year 1981 until the date of the issuance of this law set by law provided by the ACIJLP.
